Prof. Florin Hilbay calls for "a rule of law petition"

Over 300 lawyers responded to a call on #ConveneCongress, and have asked the Supreme Court to issue a writ of mandamus to compel both Houses of Congress to hold a joint session to review President Duterte’s martial law proclamation and suspension of the privilege of the writ of habeas corpus in Mindanao.

Professor Florin Hilbay who initiated the call, described it as “a rule of law petition.” The Ex-SolGen and counsel for the petitioners, who also teaches Constitutional Law, said of the petition: “what we’re asking for is compliance with the minimum procedural fidelity with the Constitution.”

In a separate action the Supreme Court is set to hear in oral argument the petition of opposition lawmakers questioning the constitutionality of the President’s declaration of martial law and the comment of the Solicitor General. The hearing is set for 13-15 June 2017.
